Gifted Deposit Independent Legal Advice
Independent Legal Advice Made Simple and Efficient
If you’re providing a gifted deposit to help someone purchase a property, your lender or solicitor may require you to obtain Independent Legal Advice (ILA).
This requirement often arises in conveyancing transactions, particularly when:
- Parents gift money to children to help them secure a mortgage or buy their first home.
- Funds are raised through remortgaging an existing property to provide the deposit.
- A financial gift is made to a partner or family member to help them purchase property.
- Large sums are transferred to meet deposit requirements, raising lender concerns about future claims or obligations.
For lenders and solicitors, it’s about satisfying their duty of care to ensure the gift is genuinely unconditional and the person gifting the money fully understands that they will have no legal interest in the property being purchased.
However, we know that in most cases, you already know exactly what you’re doing, and this can feel like an unnecessary step when you’re simply helping a loved one. That’s why ILA-Connect is here—to make the process as affordable, quick, and hassle-free as possible.
